PIONEERS OF MEDICAL CANNABIS: JACK HERER

Jack Herer (June 18, 1939 – April 15, 2010)

Jack Herer died April 15, 2010. I got the news that day as I checked my emails between flights on the way to Rhode Island for the Patients Out of Time Conference. (Conference report below)

The whole day I saw friends of Jack react to the shock of the sad news.

And of course, we ALL had a Jack Herer story to tell.

Dr. Frank Lucido's Jack Herer story, short and sweet:

I have a hemp suit made for my wedding in November, 1996, just 2 weeks after passage of the Compassionate Use Act of 1996 ("Prop 215" or California Health and Safety Code 11362.5).

The suit has lasted longer than the marriage, and I have often worn it at holiday parties, and especially at Ed Rosenthal's Festivus Celebration each December.

I was aware of an old photo of Jack in a hemp suit, so was not totally surprised when, at my first Festivus, around 1998 or 1999, a young couple came up to me, and the man asked very respectfully: "Are you Jack Herer?" I told them that I was sorry to disappoint them, but that I was honored!

Years later, at a subsequent Festivus celebration, after I had gotten to know Jack a bit, I was sitting next to him, wearing my hemp suit, and got to tell Jack how honored I was to be mistaken for him at my first Festivus.

Jack's Pledge:

I just found my copy of the Eleventh Edition of The Emperor Wears No Clothes, 1998

It was a special all-hemp clothbound edition.

#682 of 1000 copies.

Jack had signed it for me:

I didn't know Jack well at that time, but I have seen him at least 1 or 2 times a year since then, and was always impressed by his dedication to the cause of legalizing marijuana.

I just re-read the dedication of the book, and source of his dedication.

He dedicated it to his friend Edwin “Captain Ed” M. Adair III

Born October 29, 1940; Died August 16, 1991 of Leukemia

Jack says of Captain Ed:

"He taught many of us how to save the Earth from ourselves and to laugh at and yet love its enemies.

...Ed’s pledge that I took in 1974 and again in April 1980, 1986, and 1988, and finally in the hospital four days before he died in August 1991, was that we’d swear to work every day to legalize marijuana and get all pot prisoners out of jail, until we were dead, marijuana was legal, or we could quit when we turned 84. We wouldn’t have to quit, but we could.

...Captain Ed gave us and me hemp as one of mankind’s most honorable and most important saviors. I vow to continue the fight, and I ask my fellow Californians, all Americans, and the rest of the world to join us."

This was held at the Berkeley Public Library, 2 blocks from office.

We had good attendance, in spite of downpour 1 hour prior to start of event.

Those attending got their many questions answered from some experts.

Besides me, my other panelists were:

-William Panzer, co-author of Prop 215, SB420, attorney Oakland California, and my attorney for Prop 215, SB 420 issues, and a good friend

-Valerie Corral, founder of WAMM, WoMen's Alliance for Medical Marijuana, co-author of Prop 215, SB420

-Jim Squatter, activist, patient advocate, expert on history and intent of SB420, and co-author of Berkeley's Measure JJ, which passed in 2008, making Berkeley the first city to create governmental body to regulate cannabis dispensaries.

The Patients, the Real Pioneers of Medical Cannabis


Many of the patients who began consulting me about medical cannabis in the early period after the passage of the California Compassionate Use Act continue to receive benefit from cannabis medicine. As of mid-February, 2010, there have been 50 patients who have returned to my office at least 10 or more times for their annual re-evaluation. One has been in 12 times, and 11 more have had 11 renewal visits. Over 250 patients have seen me at least 7 times to renew their medical cannabis recommendations!

I had this exchange with one of my long-time patients:

"Hi Dr. Lucido, This is great what you are doing. Let us just remember, that the pioneers of medical cannabis are the patients. M."

"Hi M, That's right!

If it wasn't for the patients, we wouldn't have the medical cannabis laws at all.

I can already think of some patient-pioneers , like Robert Randall, the first federal medical cannabis patient after cannabis prohibition."

I recognize the importance of the contributions of patients to the changes in the law and medical practice. and I am looking for patients who would agree to be contacted by carefully selected interviewers about their experiences with cannabis medicine ....Let me know if you are ever interested, and I can put you on a list of patients to call.

...and I certainly understand if you don't want to!"


Of course, I would never suggest coming out about your medical use to be taken lightly. It should be given some thought, and I would be happy to speak to anyone about the pros and cons of doing so.


When I think of those patients who have come out publicly about their use of medical cannabis, I first think about courage of the Federal Patients who have been willing to speak out:

Robert Randall, the first federal patient, died before I got a chance to meet him;

And my friends Elvy Musikka, Irv Rosenfeld, and George McMahon, with whom I have shared many opportunities to speak about this safe and effective medicine. .


Of course, there is one of my own cannabis patients whose case I have permission to talk publicly about: Angel Raich, who took her case the Supreme Court .See my earlier blog post:

My one minute review:

"It's the book I wish I had written.

Yes, you can quote me.

This is a book accessible to patients, caregivers, politicians, journalists, and patient- advocates, yet informative and authoritative enough to be useful to most practicing physicians."

In fact, I think this book is so important that I now give a gift copy to each patient at the time of his or her 10th annual medical cannabis evaluation in my office.
